Employers Who Provide Comp Time in Lieu of Overtime Pay Violate the Law (FLSA)

Time and time again we talk with experienced business owners who make big mistakes when it comes to deciding whether someone is entitled to minimum wage or overtime under the federal Fair Labor Standards Act (FLSA). Here is a common mistake made by Houston, Sugar Land and Stafford TX employers who try to offer comp time in lieu of overtime pay. Although we hear very often of employers who try to offer comp time in lieu of overtime pay, it is likely a violation of the FLSA. Some employees may even prefer comp time instead of overtime, but it is still a violation if an employee works more than 40 hours in a workweek.
